These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and ClearFlow Plumbing & Waterproofing Ltd (“ClearFlow,” “we,” “us,” or “our”), a limited liability company registered in the State of Texas and operating from 2847 Riverside Drive, Suite 105, Houston, TX 77042. These Terms govern your use of our website at auditpro.pro and your engagement of our plumbing and waterproofing services.
By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree to any provision of these Terms, you must discontinue use of our website and services immediately.
1. Acceptance of Terms
By using the ClearFlow website, requesting an estimate, scheduling an appointment, or accepting any services from ClearFlow, you acknowledge that you have read, understood, and agree to abide by these Terms in their entirety. These Terms apply to all visitors, clients, and any other parties who access or use our website and services.
We reserve the right to modify these Terms at any time. Changes will take effect immediately upon posting to this page. Your continued use of our website or services following any modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for updates.
If you are engaging our services on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and references to “you” or “your” shall include that entity.
2. Services Description
ClearFlow provides professional plumbing and waterproofing services to residential and commercial clients throughout the greater Houston metropolitan area. Our services include, but are not limited to:
- Drain Cleaning: High-pressure water jetting, mechanical snaking, camera inspections, root intrusion removal, and preventive drain maintenance.
- Waterproofing: Interior and exterior waterproofing systems, foundation membrane application, French drain installation, sump pump installation and repair, crawl space encapsulation, and roof waterproofing.
- Pipe Maintenance: Leak detection, pipe relining and rehabilitation, copper and PEX repiping, backflow preventer installation and testing, and scheduled maintenance programs.
- Emergency Plumbing: 24/7 emergency response for burst pipes, sewage backups, flooding, gas line leaks, and other urgent plumbing situations.
- General Plumbing: Fixture installation, water heater repair and replacement, garbage disposal installation, faucet and toilet repair, and water filtration systems.
The specific scope, timeline, and cost of any work will be outlined in a written estimate or service agreement provided to you before work commences. ClearFlow reserves the right to decline any project at its sole discretion.
3. Estimates and Pricing
ClearFlow provides free, no-obligation estimates for standard plumbing and waterproofing projects. Estimates are based on the information available to our technician at the time of the assessment, including visual inspection and any diagnostic testing performed during the evaluation.
3.1 Estimate Validity
Written estimates are valid for 30 calendar days from the date of issue unless otherwise stated. After this period, pricing may be subject to change due to fluctuations in material costs, labor availability, or changes in the scope of work.
3.2 Scope Changes
If, during the course of an approved project, additional work is discovered that was not included in the original estimate (for example, hidden water damage behind walls, deteriorated pipes not visible during initial inspection, or code compliance issues), ClearFlow will inform you of the additional work required and provide a supplementary estimate. No additional work will be performed without your written or verbal approval, and we will document the date and time of any verbal authorizations.
3.3 Pricing Transparency
All estimates include a breakdown of labor costs, material costs, and any applicable fees such as permit fees or equipment rental charges. Sales tax will be applied in accordance with Texas state and local tax regulations. ClearFlow does not charge hidden fees, and the final invoice will reflect the agreed-upon estimate unless scope changes have been approved as described above.
4. Payment Terms
Payment for services is due upon completion of the work unless alternative arrangements have been agreed to in writing. For larger projects, ClearFlow may require a structured payment schedule as follows:
- Projects under $1,000: Payment in full upon completion.
- Projects between $1,000 and $5,000: A deposit of 25% is due upon acceptance of the estimate, with the remaining balance due upon completion.
- Projects exceeding $5,000: A deposit of 25% is due upon acceptance of the estimate, a progress payment of 50% is due at the midpoint of the project, and the final 25% is due upon completion and your approval of the finished work.
4.1 Accepted Payment Methods
We accept payment by cash, personal or business check, all major credit and debit cards (Visa, Mastercard, American Express, Discover), ACH bank transfer, and digital payment platforms. Checks should be made payable to “ClearFlow Plumbing & Waterproofing Ltd.”
4.2 Late Payment
Invoices not paid within 30 days of the due date will be subject to a late fee of 1.5% per month (18% per annum) on the outstanding balance, or the maximum rate permitted by Texas law, whichever is lower. ClearFlow reserves the right to suspend ongoing work, withhold warranty coverage, or engage a collections agency for accounts that remain delinquent beyond 90 days.
4.3 Disputed Charges
If you believe any charge on your invoice is incorrect, you must notify us in writing within 14 days of the invoice date. We will review the disputed charge and respond within 10 business days. Undisputed portions of an invoice remain due according to the original payment terms.
5. Warranties
ClearFlow stands behind the quality of its workmanship and the materials we install. Our warranty terms are as follows:
5.1 Workmanship Warranty
All labor performed by ClearFlow technicians is covered by a 12-month workmanship warranty from the date of project completion. If a defect in our workmanship is identified within this period, we will return to your property and correct the issue at no additional cost to you.
5.2 Materials Warranty
Materials and components installed by ClearFlow are covered by the manufacturer’s warranty, which varies by product. We will assist you in filing any manufacturer warranty claims and will handle the replacement or repair process on your behalf whenever possible. ClearFlow does not provide its own warranty on materials beyond what the manufacturer offers.
5.3 Warranty Exclusions
Our workmanship warranty does not cover issues arising from:
- Normal wear and tear, including gradual corrosion and mineral buildup
- Misuse, abuse, or unauthorized modifications to the work performed by ClearFlow
- Damage caused by third parties, including other contractors
- Acts of nature, including flooding, earthquakes, soil movement, or severe storms
- Failure to follow maintenance recommendations provided by our technicians
- Pre-existing conditions that were disclosed to the client prior to commencement of work
6. Limitation of Liability
To the fullest extent permitted by Texas law, ClearFlow’s total liability arising out of or in connection with any service provided under these Terms, whether based on contract, tort (including negligence), strict liability, or any other legal theory, shall not exceed the total amount paid by you to ClearFlow for the specific service giving rise to the claim.
In no event shall ClearFlow be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of use, business interruption, or cost of substitute services, even if ClearFlow has been advised of the possibility of such damages.
ClearFlow shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather events, epidemics, supply chain disruptions, utility outages, government actions, or labor disputes. In such cases, the time for performance shall be extended by a period equal to the duration of the delay.
Nothing in these Terms shall exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
7. Client Responsibilities
To ensure the smooth and safe delivery of our services, you agree to:
- Provide accurate and complete information about the plumbing or waterproofing issue, including any known history of problems at the property
- Ensure safe and reasonable access to the work area, including clearing obstructions, securing pets, and providing adequate lighting where necessary
- Obtain any necessary permissions from property owners, homeowner associations, or landlords before authorizing work
- Notify ClearFlow of any known hazards at the property, including asbestos, lead paint, mold, structural instability, or hazardous materials
- Be available or designate an authorized representative to approve scope changes and sign off on completed work
8. Cancellation Policy
You may cancel a scheduled service appointment at no charge by providing at least 24 hours’ notice before the appointment time. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee of $75 to cover the cost of reserved scheduling and dispatch preparation.
For projects that have already commenced, cancellation terms are as follows:
- If you cancel before any work has begun on-site, any deposit paid will be refunded in full, minus any costs incurred for permits, special-order materials, or subcontractor reservations.
- If you cancel after work has commenced, you will be responsible for payment of all work completed to date, plus the cost of any materials already purchased or installed, and any non-recoverable third-party charges.
ClearFlow reserves the right to cancel or reschedule a project if site conditions are unsafe, if required permits have not been obtained, or if the client has failed to meet the responsibilities outlined in Section 7 of these Terms.
9. Intellectual Property
All content on the auditpro.pro website, including text, graphics, logos, images, photographs, videos, and software, is the property of ClearFlow Plumbing & Waterproofing Ltd or its content suppliers and is protected by United States copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, display, or create derivative works from any content on our website without our prior written consent. Limited, non-commercial use of website content for personal reference (such as printing a copy of our service descriptions for your records) is permitted.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under or in connection with these Terms shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you hereby consent to the personal jurisdiction and venue of such courts.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
11. Indemnification
You agree to indemnify, defend, and hold harmless ClearFlow Plumbing & Waterproofing Ltd, its officers, directors, employees, agents, and subcontractors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your breach of these Terms, your misuse of our services, or your violation of any applicable law or regulation.
